These Terms & Conditions ("Terms") govern your use of the Fydigit website and any services, proposals, or deliverables provided by Fydigit ("we", "us"). By browsing this site or engaging our studio, you agree to these Terms and our Privacy Policy.
You may access this website for legitimate business purposes. You agree not to attempt unauthorized access, introduce malicious code, scrape content, or use materials without permission. Information on this site is for general guidance and does not constitute legal, financial, or tax advice.
Project scopes, deliverables, and fees are documented in proposals or Statements of Work (SOW). If a conflict exists, the signed SOW overrides these Terms. Invoices are payable as stated; late payments may pause work, delay launches, or incur finance charges.
You agree to provide timely access to stakeholders, systems, content, approvals, and credentials needed to deliver the work. You are responsible for ensuring assets supplied to Fydigit are accurate, lawful, and comply with intellectual property, privacy, advertising, and data protection requirements.
Fydigit follows Google Ads, Meta, LinkedIn, and ASCI policies, plus applicable advertising laws. We may refuse or suspend any activity that appears unlawful, misleading, unsafe, or non-compliant.
Each party retains ownership of pre-existing materials. New deliverables created by Fydigit transfer to you upon full payment, except for third-party licenses or open-source components that remain subject to their respective terms. Unless restricted by the SOW, we may reference non-confidential work in our portfolio.
Both parties agree to keep confidential information secure, use it only for the project, and share it solely with personnel or vendors under similar obligations. Confidential information does not include material that becomes public through no fault of the receiving party.
We process personal data according to the Privacy Policy and any mutually executed Data Processing Addendum. When sharing customer or employee data with us, you confirm you have the legal basis to do so.
We provide services with professional care and skill. Except as expressly stated in a signed agreement, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Fydigit’s total liability arising from these Terms or our services is limited to the fees you paid to us in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, punitive, or special damages.
Either party may terminate a project with written notice per the SOW. Upon termination you must pay for work completed and approved expenses. We may terminate immediately if you breach these Terms, fail to pay, or engage in unlawful activity.
Links to third-party resources are provided for convenience and do not imply endorsement. We are not responsible for the content, availability, or policies of third-party sites or tools.
We may update these Terms to reflect new services, regulatory changes, or operational improvements. Updates become effective once posted. Continued use of the site or services after changes means you accept the revised Terms.
